counter suit filed, CA's response

I filed a counter suit against a CA that got a default while I was in Iraq for fdcpa and fcra violations.
They reported things to my CR that were incorrect, I snet them a letter to correct it, they reported that they TL was due to divorce procedings, I asked them to correct it because I was never married. They said they have proof and will not correct it. I asked them six times and they refused.
Their answer to the motion is that they are not bound by the FDCPA or FCRA because the suit is over medical bills. Which as I may add are over 10 years old.

Talk about desperation:  Of course a third-party CA is covered by the FDCPA and FCRA, even if it's out-of-statute medical bills that are NOT YOURS.  The fact that you have repeatedly told them that the bills are NOT YOURS and could never have been and the disputed is laughed off only makes them look even more stupid.

This ought to be interesting...make sure you demand the proof in discovery.

Another amazing statement. I don't know why companies put up these whimpy arguments. They should just pay up and save everyone time and money.

Any Judgement they received while you were serving overseas on active duty would be in contravention of the Soldier and Sailors relief act, and probably could be reversed.
