I'm to court on tuesday and just wondering if anybody could help me raise my defense's
The story is that Asset Acceptance had bought this account from Capital One and now they are trying to collect. I  sent them my defense's as to that there is no knowledge of this account and I have requested the original statements of the account. They have not sent me anything but a motion to throw out my answer. They did not attach a contract to the original complaint nor did they out a statement of why the could not attach it. BUT THEY ARE SUEING FOR BREACH OF CONTRACT. Also they say the account is in the statue of limitations but they havnt shown the last date of activity. PLEASE HELP

you should be prepared as much as possible ..  so ... what state and court are you in?

We have been taking Cap1 apart with arbitration (its too expensive to arbitrate).

JDB's seem to fold faster than OC's when you do this.
